Terms of Use & License

1) Definitions

  • Content: images, previews, watermarked assets, and related metadata on the site.
  • User: any person/entity accessing or using the site.
  • Plan Terms: the plan page, order, receipt/invoice, license record (if any), or written agreement tied to your subscription/purchase.
  • HQ Content: original/high-resolution files (including originals and near-original derivatives).
  • Web-size Content: non-HQ derivatives intended for screen preview, drafts, and moodboards (as described in your Plan Terms).

2) Nature of Content

Content consists of synthetic creative imagery produced through a computer-assisted creation and human curation workflow. Subjects are synthetic personas and do not represent any real individual.

3) License Grant

Subject to compliance and (where applicable) payment, we grant a revocable, non-exclusive, non-transferable, non-sublicensable limited license to use Content within your Plan Terms.
HQ Content is provided only under a paid plan (Paid) or a written Enterprise/Custom agreement. Free accounts (including free logged-in users) may receive Web-size Content only, if included in the Plan Terms.
No resale, redistribution, sharing, or providing original or near-original files to third parties unless explicitly permitted in writing.

4) Permitted Uses (Summary)

You may use Content for typical creative and commercial purposes (web, social, ads, marketing materials, presentations, editorial illustration, etc.) within your Plan Terms.
Download specs, quantities, seats, and print/video scope are defined by your Plan Terms. If Plan Terms conflict with these Terms, Plan Terms control.
Paid plans generally include: HQ downloads + commercial use (including editorial use), subject to the Plan Terms/license record.

5) Prohibited Uses (Key)

You may not (and may not allow others to) use Content for or in connection with:

  • Impersonation or deception: dating profiles, fake IDs/resumes, false endorsements, fake “real person” accounts, or implying a depicted person is real.
  • Illegal or harmful activity: defamatory, harassing, hateful, violent, unlawful conduct, or incitement.
  • Privacy-invasive surveillance or sensitive profiling/targeting.
  • Facial recognition / biometrics: identification, matching, biometric training, or dataset building.
  • High-stakes implied real-person endorsement: political, medical, financial, or legal endorsement/testimony/claims.
  • ML training / datasets: training, fine-tuning, evaluation, datasets, embeddings, or similar uses without written permission.
  • Resale/redistribution: providing original or near-original files as packs, templates, libraries, memberships, or any stock-like redistribution.
  • Removing/bypassing protective measures: watermarks, anti-hotlinking, access controls, etc.
  • Trademark/primary brand identity use: logo, trademark registration, or primary brand identity use without written permission.

6) Your Responsibility & Costs

You are responsible for your use (and your team/clients’ use) and for complying with applicable law, platform rules, and industry standards. You must review Content before publishing and assume all risks arising from your use.
You agree that all costs, fees, and expenses related to your use of the site, services, or Content (including production/publishing costs, platform fees, compliance costs, dispute handling costs, and attorney fees) are solely your responsibility, and we will not be responsible for or reimburse any such costs.

7) IP

Content remains owned by us/licensors. The license is not a transfer of ownership. No trademark/logo registration or primary brand identity use without written permission.

8) Billing & Refunds

Digital access/delivery is generally non-refundable once provided, except where required by law. Billing issues: contact@candidfolio.com.

9) Takedowns, Changes, Availability

We may remove, modify, restrict, or adjust availability of Content for risk, complaints, compliance, quality, or operational reasons.
You agree we are not responsible for any costs, fees, expenses, or losses arising from such actions.

10) Disclaimer

Provided “as is.” No warranties of fitness, uninterrupted availability, error-free assets, or third-party platform approval. You assume all risks arising from your use.
You understand and agree we do not provide legal, compliance, or professional advice; you must assess and consult professionals as needed.

11) Limitation of Liability (Strong Form — Including Any Fees)

To the maximum extent permitted by applicable law, we disclaim all liability arising out of or related to your use of (or inability to use) the site, services, or the Content (whether in contract, tort, negligence, strict liability, or otherwise), including any direct, indirect, incidental, special, punitive, or consequential damages, loss of profits, business interruption, loss of data, or loss of goodwill.
This includes, without limitation, any costs, fees, or expenses of any kind (including attorney fees, compliance costs, substitute procurement/substitute services costs, and production or advertising spend).

Where liability cannot be fully excluded under applicable law, we will only be liable to the minimum extent required by applicable law. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.

12) Indemnity

You will defend and indemnify us against claims arising from your breach, misuse, or unlawful use, including reasonable attorney fees.

13) Termination & Remedies

We may suspend/terminate immediately for breach or material risk. You must stop new use upon termination. We may seek injunctive/equitable relief where appropriate.

14) Changes

We may update these Terms by posting on the site; continued use means acceptance.

15) Governing Law

These Terms are governed by the laws of California, USA. Except where applicable law requires otherwise, disputes will be brought in courts of competent jurisdiction in California, USA.
